1. Disposable Vape Product Registry

Florida has become the first state to establish a registry for disposable nicotine products deemed attractive to minors. Beginning January 1, 2025, the Florida Department of Legal Affairs is required to maintain and publicly update a list of such products. Retailers and wholesalers have 60 days to sell or remove any products added to this list; failure to comply can result in fines up to $1,000 per day per product starting March 1, 2025.

2. Age Verification and Penalties

The legal age for purchasing nicotine products in Florida remains 21. Retailers are now mandated to use electronic ID scanning systems to verify the age of customers. Selling to a minor for the third time is classified as a third-degree felony, carrying penalties up to $5,000 in fines and five years in prison.

3. Public Use Restrictions

Vaping is prohibited within 1,000 feet of schools between 6:00 a.m. and midnight. Additionally, vaping is banned in enclosed indoor workplaces, certain courthouses, and detention facilities. Some exceptions exist, such as designated hotel rooms and certain retail vape shops.

4. Flavored E-Liquids and Open Systems

While flavored e-liquids remain legal, the state has introduced measures to restrict products that appeal to minors. Open-system devices and bottled e-liquids are not subject to the disposable product registry, allowing for broader availability of these products.
